1. DESCRIPTION OF CONTEST: The ANYTHING BUT HAIR ("Contest") is sponsored by Pivot Point International, Inc. ("Sponsor"). In this Contest, Entrants will have the opportunity to compete for the awards described in Section 8 below by submitting an original hair-like design without using any human or artificial hair. The design must be created solely by the Entrant and be presented on a headform, mannequin, or live model (Sponsor has provided acceptable headform template if Entrant does not have one available to them). Entrants can use any material but hair to achieve the design. The Entrant's submission must consist of at least two photos showing their design from the front and back. Entrants must also fill out the entry form, answering in 250 to 300 words how they created their design and the concept or inspiration behind it, why they should receive full paid tuition for the cosmetology program at Pivot Point Academy, why they think they would benefit from a Pivot Point education, and how they will utilize their education in the future. Each Entrant will have the opportunity to compete for full paid cosmetology tuition to the Evanston, Bloomingdale or Chicago Academy, as specified below. Additionally, fans of Sponsor's Facebook page will have an opportunity to vote for a fan favorite. The fan favorite will receive a $100 gift card, as specified below. There are two phases to the Contest: the entry period and the voting period. Each phase is described below. NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN. VOID WHERE PROHIBITED.
2. ELIGIBILITY: The Contest is open only to Entrants who are 18 years of age or older at the time of entry, and are legal residents of the State of Illinois. To be eligible for the paid tuition, Entrants must meet the eligibility requirements for the paid tuition described below (each an "Entrant"). Employees and directors of Pivot Point International, Inc., its parent and subsidiary companies, and any advertising or promotional agencies involved in this Contest, as well as their legal advisors and the immediate family or members of their same households of such employees and directors, are not eligible to enter or win. As used in these Official Rules, "immediate family members" means spouses, children, siblings, parents, grandparents and grandchildren.
In order to be eligible for the scholarship award, an Entrant must meet the following additional requirements:
- Must be a new student to a Pivot Point Academy
- Must have a high school diploma or GED
- Must complete an interview with an admissions representative by December 20, 2011, and pass an entrance exam
- Must be able to begin class by February, March, April, or May 2012
- Must use full paid tuition for cosmetology program only
- Fully complete entry form below with valid contact information
- Attend the Pivot Point Evanston, Bloomingdale or Chicago Academy cosmetology program that is a 1,500-hour program in preparation for licensure exam for the State of Illinois.
- Must submit a weekly blog post to Sponsor that documents their educational experience. (All blog post submissions are subject to editing by the Sponsor.)
- Must submit a monthly blog post for FirstChair.com, an imprint of Modern Salon Media and Vance Publishing. (All submissions are subject to editing by Sponsor and FirstChair editor.)
- Must maintain a physical and online photo portfolio of their educational progress such as classroom experiences, and hands-on mannequin exercises as well as services performed on salon clients, e.g. before and after photos of hair cuts and other services.
3. HOW TO ENTER: The Contest starts October 3, 2011, at 10:00 a.m. Central Time ("CT") and ends November 11, 2011, at 11:59 p.m. CT (the "Entry Period"). The clock on Sponsor's computer will be the official clock for the Contest.
During the Entry Period, eligible Entrants can enter the Contest by going to www.facebook.com/PivotPointInternational ("Web Site") and clicking on the "Enter" link for the Pivot Point Anything But Hair Contest entry form and photo upload page. This will direct you to a microsite hosted by WildfireApp.com. Follow the instructions on the page and complete the entry form by filling out your full name, complete home address including zip code, email address, and any other requested fields. Before you will be able to register and submit your photos, you must expressly agree and consent to be bound by these Official Rules, and the Privacy Policies of Sponsor, the Web Site, and Wildfire Interactive, Inc., and the decisions of Sponsor and the judges for this Contest and to be contacted by email, phone or by regular mail relating to this Contest. If you do not agree to these terms, please do not use the Web Site or enter the Contest. If you do agree, then follow the onscreen instructions to complete and submit an entry registration form and photos.
You will be prompted to upload your photos and complete the entry form, along with your 200-300 word statements (collectively referred to as your "Submission" or "Entry") and will be required to agree that (a) you have read or had read to you these Official Rules and are in agreement with them, and (b) you have received permission for the use of the likeness and image of all identifiable people appearing in your Submission and to grant to Sponsor the rights contemplated in the Official Rules. You must complete and submit the entry form as instructed during the registration process. Submissions must also comply with the requirements set forth in Section 4. Sponsor may, at its sole discretion, remove, delete and/or disqualify any Submission it deems inappropriate or otherwise non-compliant with these Official Rules. Your Submission must be at least two photos showing the front and back of the original design created solely by Entrant. Photos cannot not be altered via Photoshop or other photo editing software.
Limit one (1) Submission per person. If any individual, in the sole discretion of Sponsor, is suspected of submitting more than one Submission by any means, including but not limited to establishing multiple email accounts, he/she will be disqualified from participating in this Contest. The name of the person submitting the Contest entry must be the authorized account holder of the email address listed on the entry form; otherwise, the entry may be deemed void. In the event of a dispute over the identity of a potential winner, the entry will be declared made by the authorized holder of the email address submitted at the time of entry, and potential winner may be required to provide sufficient identification to show that he/she is the authorized account holder of such email address. "Authorized Account Holder" is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. It is the sole responsibility of the Entrant to notify the Sponsor in writing if the Entrant changes his or her email or postal address during the pendency of the Contest. Proof of submission of entry does not constitute proof of delivery or entry. All entries become the property of Sponsor and will not be acknowledged or returned to Entrant. Each entry must be manually keystroked and manually entered by the individual Entrant; automated and/or repetitive electronic submission of entries (including but not limited to entries made using any script, macro, bot or Contest service) will be disqualified and transmissions from these or related email or IP addresses may be blocked.
4. SUBMISSION REQUIREMENTS:
A. Photos must be in one of the following formats: acceptable image formats are .jpg, .gif, .png; there are no size requirements for the images.
B. Submissions must be in the English language or be subtitled in English.
C. Submissions must be the original creation of the submitting Entrant and should show Entrant's hair-like design without using any human or artificial hair. Entrant is required to obtain written permission from the live model to appear in the Submission. No minors may be featured in the Submission.
D. Entrants agree to and understand that Submissions will be made available to the public, including but not limited to posting on the Internet. Regardless of whether or not Submissions are published on the Internet, Sponsor does not guarantee any confidentiality with respect to any Submission.
E. Entrants are responsible for securing necessary permissions, talent and location releases, and licenses for any visual and audio material contained in the Submission.
F. A Submission may not contain or depict someone smoking or intoxicated, contain an advertisement or a solicitation of any business, or include an impersonation of someone.
G. Submissions may not contain unsafe behavior or situations, profanity, nudity, pornographic images or explicit sexual themes, graphic violence, defamatory or libelous statements or material considered to be illegal. Submissions containing any such aspects and/or that are in violation of law or otherwise deemed by Sponsor, in its sole discretion, to be prejudicial to Sponsor or inappropriate in any way will be disqualified. Submissions determined, in Sponsor's sole discretion, to infringe on any intellectual property rights or other rights will be disqualified.
H. Each Submission must be an original work that is under no restriction, contractual or otherwise, that will prevent Sponsor's use of the Submission and each Submission must be free of any and all liens, encumbrances and claims of third parties.
I. Sponsor is not responsible for any expenses incurred in the production and delivery of the Submissions.
5. REPRESENTATIONS REGARDING SUBMISSIONS; GRANT OF RIGHTS: By submitting a Submission in connection with the Contest you represent and warrant to Sponsor that (i) your Submission is your own original work and that you have the sole right to submit it to the Contest; (ii) your Submission does not violate in any way the rights of third parties, including but not limited to copyright and other intellectual property rights; (iii) your Submission does not violate any applicable laws; (iv) you have obtained all necessary licenses or permissions from all appropriate third parties required for the production and submission of the Submission in the Contest and for use by Sponsor as contemplated in these Official Rules; (v) the posting and/or display of your Submission or other use by Sponsor or those deriving rights through Sponsor will not violate the intellectual property rights or rights of publicity or rights of privacy of any third parties or otherwise breach any provision of any applicable law or regulation; (vi) Sponsor has your irrevocable permission for the posting of your name, your city and state and any and all information included in your Submission in connection with any permitted use of your Submission; (vii) use and posting of the Submission or any part of the Submission provided by you to Sponsor in any manner in connection with the Contest or as otherwise permitted by these Official Rules is and will be without any compensation, regardless of whether your Submission is the winning Submission; and (viii) your Submission has not been entered in or has not won any previous competitions, contests, prizes or awards. By submitting your Submission to the Sponsor in connection with the Contest you agree to and thereby waive any and all moral rights that exist in your Submission to the Contest and any derivative works made therefrom.
All Entrants hereby grant to Sponsor an everlasting, royalty-free, assignable and irrevocable license to use, utilize, replicate, alter, adapt, modify, publish, broadcast, translate, produce derivative works from, distribute, present, display, sublicense and exercise all copyright and other intellectual property and personal rights with respect to each Submission worldwide and/or to include a Submission in other works in any media now known or later created, anywhere and forever. Each Entrant agrees and grants Sponsor permission to make available and display/perform and otherwise distribute Entrant's Submission in all media in perpetuity without compensation. Except where legally prohibited, entry of a Submission into this Contest constitutes permission for Sponsor to use the Entrant's name, address (city and state) and Submission in print, electronic media, broadcast media or any now known or later created media, in perpetuity, in any manner Sponsor deems appropriate in connection with promoting the Contest and Sponsor's business, products and services, without further compensation.
In the event that an Entrant breaches any of his or her representations, warranties or undertakings to Sponsor, Sponsor shall be entitled to and may seek indemnification from Entrant for recovery of all legal fees, damages, losses claims and other expenses that may be incurred by Sponsor or its affiliated entities as a result of such breach or any use of Entrant's Submission.
6. SELECTION OF SCHOLARSHIP AWARD WINNER: A panel of judges consisting of Pivot Point International staff and industry professionals selected by Sponsor will determine the winner of the scholarship award. Entries will be judged based on the originality and creativity of the design and materials utilized to create the design, the photo Submissions, the essays, and adherence to the technical rules of the Contest (the "Contest Criteria"). The Submissions with the two (2) highest scores will be declared finalists for the paid tuition prize. The finalists will be notified via email, telephone and/or U.S. Mail on or before November 30, 2011. Each finalist will then be required to attend an interview in person at Pivot Point Academy in Evanston, Illinois. Sponsor will determine the paid tuition recipient based on the results of his or her interview and other entrance requirements. The winner will be selected at the sole discretion of Pivot Point and its representatives, and is expected to be announced and displayed on the custom Wildfire application on Facebook on or before January 10, 2012.
7. VOTING FOR FAN FAVORITES: The fan favorite voting phase of the Contest will begin on October 3, 2011, at 10 a.m. CST and continue through December 9, 2011, at 11:59 p.m. CST ("voting period"). Approved photo Submissions that appear to meet all of the required criteria will be posted on the custom Facebook application on the Sponsor's Facebook fan page. The fan favorite will be determined by followers of the Sponsor's Facebook page. Fans will be asked to cast votes by being directed to an application provided by Wildfireapp.com in which they can vote either "thumbs up" or "thumbs down" on the posted Submissions based upon which best meets the Contest Criteria. A person may not vote more than one time for any particular Submission. The Submission that receives the most valid "thumbs up" votes during the voting period will be declared the fan favorite winner, subject to compliance with all requirements of these Official Rules. Fan favorite winner will be announced on or about January 10, 2012, on the custom Wildfire application page on Facebook. The finalists for the scholarship award will not be eligible to win the fan favorite portion of the Contest. If any such finalist receives the most fan votes, then winner will be the Entrant with the next most valid "thumbs up" votes that is not a finalist for the scholarship award.
Entrants are prohibited from obtaining votes by any fraudulent or inappropriate means, including, without limitation, offering prizes or other inducements, as determined by Sponsor in its sole discretion. Multiple voters are not permitted to share the same e-mail address or Facebook account and a person may not vote on the same Submission twice. Any attempt by any voter to submit more than the stated number of votes by using false or fictitious names or email addresses, multiple/different e-mail addresses, identities or any other method will void that voter's entry (if any) and votes and he/she will be disqualified from further participation in the Contest. All decisions made by Sponsor regarding the disqualification of votes or any Entrant will be in Sponsor's sole discretion and final and binding on all Entrants. Use of script, macro or any other automated system to vote is prohibited and all such votes utilizing those means will be void.
Subject to such person's compliance with these Official Rules, the Entrant who receives the highest number of Facebook fan votes during the Voting Period will be deemed the provisional Fan Favorite. In the event of a tie in the number of votes received, Judges appointed by Sponsor will determine the winner of the applicable prize based on the criteria set forth in Section 6 above. Sponsor reserves the right to award fewer than the stated number of prizes, if, in its sole discretion, it does not receive a sufficient number of eligible and qualified Submissions. Sponsor also reserves the right, in its sole discretion, to select an alternate winner based on the Contest Criteria in Section 6 should the voting appear to have been tampered with or manipulated in any way.
8. AWARDS: After applicable verification and subject to compliance with these Official Rules, the following are the awards to be provided to the Contest winners:
Scholarship Award Winner: Full tuition to Evanston, Bloomingdale or Chicago Pivot Point Academy 1500-hour Cosmetology program. Winner must be able to start in February, March, April, or May 2012 class. Approximate Value: $20,979. The winner must attend the Cosmetology program at one of the three campuses (Evanston, Bloomingdale or Chicago). The full tuition credit covers tuition, books and student kit only and does not cover any other costs or expenses of attending the program, including, but not limited to, room and board, moving expenses, transportation, or additional credit hours required by States outside of Illinois, all of which are the sole responsibility of the winner. Additionally, the winner will receive a monthly blog post in firstchair.com.
In addition, the winner must meet all ongoing academic and other academy requirements to maintain the full tuition, including, but not limited to, the following:
In addition to maintaining satisfactory academic progress rates in order to receive and remain eligible for this scholarship, the winner is required to maintain the following:
90% cumulative attendance rate
80% cumulative grade point average
The winner understands that if deemed to be progressing below these rates, he/she will be at risk of forfeiting this scholarship award as follows:
Written Notice: First instance in which the student is below the required cumulative rates during monthly attendance monitoring .
Final Notice: Second instance in which the student is below the required cumulative rates during monthly attendance monitoring.
Paid Tuition Forfeit: If a student fails to progress at or above the required rates a third time during monthly attendance monitoring, the scholarship will be revoked and the student will be responsible for the paid tuition amount. This amount will be incurred as a monthly payment over a set amount of months based on the program schedule.
The winner understands that the penalty for violation of Pivot Point's rules, regulations, policies or procedures (as stated in the Student Handbook and at Academy Management's discretion) could result in the paid tuition being revoked and winner would be responsible for the full tuition amount. This amount will be incurred as a monthly payment over a set amount of months based on the program schedule. In addition, if the paid tuition is revoked, winner is also responsible for the cost of the kit, school fees and remaining tuition and any additional cost incurred while he/she is actively enrolled as a student.
Fan Favorite: The fan favorite will win a gift card to be determined by Sponsor. Value: $100. The gift card may be subject to other terms and conditions as set forth on that gift card.
Total value of all awards in the Contest: $21,079
The odds of winning in any Contest depend on the number of eligible entries received for that Contest which meet the criteria put forth by the Sponsor. No cash or other substitution, assignment or transfer of any prize is permitted, except by Sponsor, who reserves the right to substitute a prize or prize component with cash or another prize of comparable or greater value. All federal, state, and other tax liabilities arising from this Contest are the sole responsibility of the applicable winners. No more than the listed number of Awards will be granted.
9. WINNER NOTIFICATION AND AWARD FULFILLMENT: The potential award winners will be notified by email and/or U.S. Mail and/or telephone call at the e-mail and/or street address and/or telephone number provided at the time of entry. Any winner notification returned as undeliverable will result in forfeiture of the prize and if the forfeited prize is free tuition, the alternate free tuition winner may be selected at the Sponsor's sole discretion in accordance with Section 6. If the forfeited prize is the gift card to the fan favorite, then the alternate winner will be the next highest vote getter, subject to that winner's compliance with these rules. Except where prohibited, the potential winners may be required to sign and return to Sponsor an Affidavit of Eligibility/Grant of Rights/Liability Release including (where lawful) a publicity release for receipt by Sponsor by the due date indicated in the notification correspondence. In addition, the scholarship winner must complete the registration process for the scholarship as follows:
1. Interview/Tour with Admissions Representative
2. Pass Entrance Exam
3. Complete application process and submit all required documents for registration (includes proof of graduation with diploma or GED and valid I.D.)
4. Attend Class Orientation
5. Begin cosmetology class in February, March, April, or May 2012, at one of the three academy locations listed herein.
If any required documents are not returned within the number of days specified in the notification correspondence, or if any notification is returned as undeliverable, then the prize may be forfeited and an alternate winner will be selected by the Sponsor as noted above in this Section 9. The gift card will be fulfilled 8-10 weeks after winner verification.
10. PERMISSION: Where permitted by law, each winner agrees to grant Sponsor, and those acting pursuant to its direction or control (and confirm such grant in writing upon request), the right to print, publish, broadcast and use, worldwide in any media now known or hereafter developed, including but not limited to the World Wide Web, at any time or times, the winner's name, portrait, picture, voice, likeness and biographical information as news or information and for advertising, trade and promotional purposes without additional consideration, and without notification, review or approval.
11. RELEASE: BY PARTICIPATING IN THE CONTEST, ENTRANTS AGREE TO RELEASE AND HOLD HARMLESS SPONSOR, ITS AFFILIATES, SUBSIDIARIES, ADVERTISING AND PROMOTIONAL AGENCIES, AND FACEBOOK, AND ITS AND THEIR OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS (COLLECTIVELY THE "PROMOTION PARTIES") AND FACEBOOK FROM AND AGAINST ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF PARTICIPATION IN THE CONTEST OR RECEIPT OR USE OF ANY AWARD, INCLUDING PROPERTY DAMAGE, PERSONAL INJURY OR DEATH. EACH ENTRANT FURTHER AGREES THAT IN ANY CAUSE OF ACTION, THE PROMOTION PARTIES' LIABILITY WILL BE LIMITED TO THE COST OF PARTICIPATING IN THE CONTEST, AND IN NO EVENT SHALL THE PROMOTION PARTIES BE LIABLE FOR ATTORNEYS' FEES, OR PUNITIVE, CONSEQUENTIAL, DIRECT OR INDIRECT DAMAGES, AND EACH ENTRANT WAIVES THE RIGHT TO CLAIM ANY DAMAGES WHATSOEVER.
12. DISQUALIFICATION AND TERMINATION OF CONTEST. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds, in its sole discretion, to be tampering with the entry process or the operation of the Contest or the Web Site; to be in violation of the Terms of Service of the Web Site; to be acting in violation of the Official Rules; to be acting in a nonsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any use of robotic, automatic, macro, programmed or like entry methods will void all such entries by such methods and persons using any such methods will be disqualified.
If for any reason this Contest is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which, in the sole opinion of Sponsor, corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Sponsor reserves the right to cancel, terminate, modify or suspend the Contest and award the Awards among all eligible non-suspect entries received as of the date on which any such action is taken or as deemed fair and appropriate by Sponsor. If the Contest is terminated due to tampering or technical difficulties prior to its expiration date, notice will be posted at http://pivot-point.com.
ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT, TO THE FULLEST EXTENT PERMITTED BY LAW.
13. LIMITATIONS OF LIABILITY: Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Sponsor is not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer online systems, servers, or providers, computer equipment, software, failure of any email, Submission or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any Web Site, or any combination thereof.
Sponsor is not responsible for any incorrect or inaccurate capture of information or the failure to capture such information, whether caused by Web Site users, tampering or hacking, or by any of the equipment or programming associated with or utilized in the Contest and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to the Web Site. Sponsor is not responsible for injury or damage to Entrants' or to any other person's computer, related to or resulting from participating in this Contest or downloading materials from or use of the Web Site.
IN NO EVENT WILL SPONSOR, OR ITS RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS, BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR PARTICIPATION IN THIS PROMOTION, ACCESS TO AND USE OF THE INTERNET SITE WWW.PIVOT-POINT.COM <http://WWW.PIVOT-POINT.COM>, FACEBOOK, THE WEB SITE OR THE DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM SAID SITES OR SERVICES. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THESE SITES RELATING TO THIS CONTEST IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. 14. CHOICE OF LAW AND DISPUTE RESOLUTION: Except where prohibited, as a condition of participating in this Contest, Entrants agree that any and all disputes that cannot be resolved between the parties, claims and causes of action arising out of or connected with this Contest, or any Awards or the determination of winners shall be resolved individually, without resort to any form of class action, exclusively by arbitration, pursuant to the commercial arbitration rules of the American Arbitration Association then effective. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of Entrant and Sponsor in connection with this Promotion, shall be governed by, and construed in accordance with, the laws of the State of Illinois, U.S.A., without giving effect to the conflict of laws or rules thereof, and all proceedings shall take place in the City of Chicago, Illinois.
